What rights do parties have during mediation?

In Alaska, parties who are involved in mediation have certain rights that are protected by law. Mediation is a voluntary process in which two or more parties come together and attempt to resolve a dispute with the help of a neutral third party called a mediator. During the mediation process, the parties have the right to: 1. Present their own point of view and support it with facts. 2. Negotiate directly with each other or through the mediator. 3. Receive accurate and impartial information about the law. 4. Receive understanding and respect from the mediator. 5. Terminate the mediation process at any time if they feel that it is not a productive or effective way to resolve the dispute. 6. Request a break if needed during the process. 7. Ask questions when they don’t understand something. 8. Decide on a solution that they both agree on. It is important to note that the mediator cannot impose a decision on the parties. The parties have the right to come to a resolution that they both find acceptable. Furthermore, mediation offers the parties the opportunity to have their interests and rights protected without having to engage in expensive and lengthy court proceedings.
