What happens after the mediation agreement is signed?
Once the mediation agreement has been signed, the parties are legally bound to the terms of the agreement. In Minnesota, both parties should receive a copy of the agreement, and the mediator will submit the signed agreement to the court. At this point, the agreement becomes an enforceable contract, meaning the parties are legally responsible for fulfilling the terms of the agreement. Depending on the terms of the agreement, one or both parties may have to take further steps to ensure the agreement is carried out. For example, if there are payments due, the parties may need to draft and sign an additional contract specifying the payment amount, payment dates, and any other relevant details. In Minnesota, the parties may choose to have the mediation agreement reviewed and approved by the court. This court review is a way to ensure that the agreement is fair and that all the terms are legally enforceable. Once the court review is complete and the parties have completed any additional steps needed to ensure the agreement is carried out, the agreement is legally binding and the mediation process is concluded.
