Who has the right to request mediation?

In South Carolina, almost anyone can request mediation to resolve a dispute. Mediation is a process in which an impartial mediator, or third party, assists the parties in dispute to reach a mutually beneficial agreement. If the dispute is between two parties, such as two individuals, businesses or organizations, either party can request mediation. If the dispute involves more than two parties, multiple parties can work together to find a mediator and petition for mediation. In some cases, a court may require the parties to attend mediation. This is often done when the court believes mediation could be beneficial in resolving the matter. In other cases, a party may choose to go to mediation for various reasons, such as saving time and money or to preserve relationships between the parties. People who are not part of the dispute can also request mediation. This could be a parent, guardian, attorney, or a mediator who has been hired by one of the parties in the dispute. Mediation is an effective method of resolving disputes and can help parties to avoid costly litigation. If you believe that mediation may help to resolve a dispute that you are involved in, then you should contact an experienced mediator to help you understand your rights and decide if mediation is the right choice for you.
