What are the laws preventing deceptive advertising?

Deceptive advertising is a form of fraud that is illegal in Mississippi, as it is in all states, under both federal and state laws. Under federal law, the Federal Trade Commission (FTC) has the authority to investigate and stop deceptive advertising. This means that any advertisement that misleads the consumer by providing false, incomplete, or otherwise deceptive information can be subject to an FTC investigation. Under Mississippi law, the Mississippi Consumer Protection Act (MSCPA) prohibits any person or group from using deceptive or unfair practices in the conduct of trade and commerce. This law includes deceptive advertising, which means the business must not make false statements to consumers regarding goods or services. In general, deceptive advertising has five main components: the material must be deceptive or have the potential for deception, it must have been directed to the public, it must have been false, it must have caused injury to the consumer, and it must have been made with the intention to deceive. Any number of factors, including words, symbols, numbers, images, and sounds, can be used to deceive someone. Misleading statements, misrepresentations, or overstatements are all common violations of the MSCPA. Advertisers may also be found liable for false advertising even if they did not intend to deceive consumers. For example, if a business advertises a good or service without actually providing it, it could be held liable for deceptive advertising. Furthermore, businesses must ensure that all claims made in their advertising are truthful and verifiable. If a consumer believes they have been the victim of deceptive advertising, they may report the issue to the Mississippi Attorney General’s office. The Attorney General may then investigate and take legal action against the advertiser if appropriate.
