Third, the claimant must prove that they were damaged as a result of the malicious prosecution. This can be in the form of direct damage such as the costs of court or attorney fees, or indirect damages such as emotional distress or harm to their reputation. Finally, the claimant must show the lack of probable cause for the legal action that was taken. If a claimant can successfully prove that the four components existed, they may be able to receive damages from the defendant.
