What is the right to a guardianship or conservatorship?
In Pennsylvania, the right to a guardianship or conservatorship is a legal provision under mental health law. It grants an adult or a court-appointed guardian the authority to make decisions on behalf of a person who has been declared legally incompetent to make decisions on their own. A guardianship is a legal arrangement in which a guardian, appointed by a court of law, makes decisions on behalf of an individual who is determined to be legally incompetent to do so. The guardian has the authority to decide where the individual will live and to make decisions regarding medical care and other matters. A conservatorship is similar to a guardianship, but it is granted to a person or an organization to manage a person’s finances and other assets. The conservator will manage the individual’s assets and make investments on their behalf. A conservator also has the authority to act on a person’s behalf to pay bills, enter into contracts and make other financial decisions. In Pennsylvania, the court makes the decision to grant a guardianship or conservatorship. The court will appoint a guardian or conservator if it finds that the individual is legally incompetent to make decisions on their own. The guardian or conservator will then have authority to make decisions for the individual until the court modifies or ends the guardianship or conservatorship.
