Neglecting someone with mental illness can have serious legal consequences in the state of Washington. If a person is being neglected, this could constitute a type of abuse either toward themselves or toward another individual. Neglect of someone with mental illness can lead to the violation of Washington’s adult protective services laws which protect people over the age of 18 from abuse, exploitation, and neglect. If the neglected person is under 18 years of age, there are additional legal implications. The child’s caretaker or guardian could be in violation of Washington’s child abuse and neglect laws. Washington laws state that any person responsible for a child’s welfare must provide for and protect a child from neglect, physical harm, and mental harm, and failure to do so could result in criminal penalties. In cases of neglect of a person with mental illness, the caretaker or guardian could face civil and criminal liability. This means that if a caretaker neglects someone with mental illness, they could be sued in a civil court, and even face criminal charges if there is evidence of abuse. In addition, the caretaker may be subject to penalties such as fines, probation, or even jail time if found guilty of violating any laws.
