What is the difference between a Jones Act claim and a maritime personal injury claim?

The Jones Act is a federal law that provides compensation for workers who have been injured in the course of their work on a vessel or waterway. It applies to seamen who are employed by a vessel or navigable waterway in the United States and who have suffered an injury or illness due to their employer’s negligence. A Jones Act claim is a type of lawsuit that can be brought to court in order to seek compensation for the injuries or illnesses that one has suffered due to their employer’s negligence. In contrast, a maritime personal injury claim is a civil lawsuit brought against another party for suffering an injury due to their negligence. This may include claims against a boat’s captain or crew, the owner of the vessel, or another party, such as a manufacturer, who was responsible for maintaining the vessel or its crew. Unlike Jones Act claims, a maritime personal injury claim is not limited to workers on a vessel or waterway; rather, any person who has been injured in the course of their activities on the water may be able to bring a claim under maritime law.
