What are the different types of damages available in a maritime injury case?

In Washington, an injured seaman or maritime worker may be able to recover different types of damages in a maritime injury case. Damages are awarded as compensation for an injury, loss, or harm in a personal injury claim. Economic Damages refer to reimbursement for money spent due to an injury and may include medical expenses, lost wages, and lost earning capacity. Non-economic Damages include compensation for physical pain, emotional distress, loss of enjoyment of life, disfigurement, and damage to one’s reputation. Punitive Damages are to punish and deter negligent or intentional wrongful conduct. They are only available in extreme cases when the injury is caused by a defendant’s willful act or gross negligence and is meant to discourage such behavior in the future. Maritime Injury Law may also provide for other damages, such as Loss of Consortium. This type of damage awards compensation to a spouse or family member who has been deprived of their loved one’s companionship due to an injury. Additionally, a Seamen’s Maintenance and Cure Claim may be filed when a seaman is injured and needs medical care, lost wages, and other compensation during their recovery. In any maritime injury case, it is important for the injured party to seek legal guidance as soon as possible to determine which types of damages may be available.
