What is the difference between a court martial and a non-judicial punishment (NJP)?

A court martial is a military tribunal used to try service members in the U.S. Armed Forces. In the state of New York, there is no specific court martial system, but the military justice system is conducted in accordance with the Uniform Code of Military Justice (UCMJ). In contrast, non-judicial punishment (NJP) is a form of military justice that allows commanding officers to exercise disciplinary authority without using the court martial system. In New York, this can include a reprimand, reduction in rank, forfeiture of pay, restriction to certain areas, extra duties, and other penalties, with the option of imprisonment for up to a month. The most significant difference between a court martial and NJP is that a court martial is open to the public, while NJP proceedings are conducted within the command. In addition, a court martial is a criminal trial, with the accused afforded a jury of their peers and all proceedings conducted in accordance with the UCMJ. Conversely, NJP is a command-level process, and the accused does not have the same rights as in a court martial. Overall, a court martial is the most serious form of military justice discipline and should be reserved for the most serious offenses. Non-judicial punishment is a less serious form of disciplinary action and is typically used by commanding officers to address minor infractions.
