What is an Article 134 offense?

An Article 134 offense is a type of military law offense that is punishable under the Uniform Code of Military Justice (UCMJ). The UCMJ is the set of laws that governs the military in Washington State as well as all other states. Article 134 is a general article that outlines offenses such as any wrongful act or offense that is not specifically covered by another article in the UCMJ. The type of offense is classified by a “Specification”; which is a detailed description of the offense that includes elements of proof and the maximum punishment for the offense. These specifications include conduct such as disobeying an order or regulation, disrespect or language toward a superior officer, acts or words of prejudice or contempt toward a superior officer, and other similar offenses. Depending on the severity and nature of the offense, the punishment associated with Article 134 could be a reprimand, reduction in rank, forfeiting pay, and even imprisonment. In Washington State, the military has a zero-tolerance policy when it comes to Article 134 offenses. Although the punishments may not seem severe, it is important to remember that these offenses can have long-term implications, including a blemished military record and a possible dishonorable discharge. It is important to always practice utmost respect when dealing with any superior officer or military personnel in order to avoid any potential Article 134 offense.
