What is a plea bargain in a court-martial?
A plea bargain in a court-martial is when the accused agrees to plead guilty to some or all of the charges they are facing, in exchange for certain concessions from the prosecution. This could include a lighter sentence than if they were to be found guilty of all the charges. The accused must agree to the terms before the plea bargain is accepted. In a court-martial, the accused is generally allowed to make a plea bargain with the prosecution before the court-martial begins. This process is typically handled in a negotiation between the defense and the prosecution. During the plea bargain, the accused is typically given the opportunity to waive certain rights such as the right to remain silent in exchange for a lighter sentence or a favorable outcome in their case. The court-martial judge also may have final approval of the plea bargain. If the judge does not feel the agreement is in the best interest of justice, the judge may reject the plea bargain. While plea bargains are common in civilian courts, they are relatively rare in court-martials. This is because of the strict rules and regulations that are in place for the military. Prosecutors are also usually more open to plea bargains in civilian court since the consequences for the accused are typically not as severe.
