What is the rule against hearsay?

Hearsay is an out of court statement that is offered to prove the truth of the matter asserted. Under the California military law, hearsay is generally not admissible as evidence. This is because the reliability of the statement can not be determined since the statement was not made in court, under oath, and with the opportunity to be questioned. Hearsay is typically not admissible in court and as proof of a criminal offense. This is because the person making the statement is not present in court, and therefore cannot be questioned or cross-examined to verify the truthfulness of the statement. In a criminal trial, it is important for an accused person to be able to question witnesses and challenge their testimony, but this is not possible with hearsay evidence. Furthermore, military courts are limited in the type of evidence they can consider when convicting a person of a crime. For example, the court can consider evidence from a witness to prove the truth of the matter, but hearsay is not allowed. This is because hearsay evidence could be unreliable, and therefore could unfairly lead to a conviction. Therefore, the California military law prohibits hearsay evidence in criminal cases. This is to ensure that accused parties are given a fair trial, and that the court is able to consider only the most reliable evidence when making a decision.
