What is the UCMJ Article 32?

The Uniform Code of Military Justice (UCMJ) Article 32 is a U.S. military law that applies to all branches of the armed forces, including those in Maryland. This article exists to ensure that every service member is treated fairly and their rights are protected throughout the military justice process. Under Article 32, all military personnel are subject to the UCMJ and must follow the rules and regulations outlined in the code. Article 32 outlines court-martial procedures, which is a formal trial process whereby military personnel can be held accountable for any violations of the UCMJ, such as disobeying orders or engaging in misconduct. This process includes informing the service member of the charges against them, providing a summary of the evidence, allowing the service member access to legal counsel, and holding a hearing to determine guilt or innocence. Article 32 also requires that an investigation be conducted and a report be made in order to establish that the service member has committed or is alleged to have committed an offense. The report must include accurate, unbiased, and thorough information about the charge(s) and any witnesses involved, and the service member must be given the opportunity to respond to any of the allegations. This process must be conducted by a competent authority and is conducted to ensure that all information is properly evaluated before a military member is found guilty.
