What is the UCMJ Article 39?

UCMJ Article 39 is a United States military law that governs trial procedures before courts-martial. It is part of the Uniform Code of Military Justice (UCMJ). Article 39 states that a court-martial may only convene after it is properly convened. It outlines the procedures for convening courts-martial, including the requirements of a president, trial counsel, and members. Article 39 also outlines the rules and regulations for the conducting of a court-martial, including the selection of the members that will serve, the qualifications of the members, their rights and powers, their oath, and the manner in which the members are selected. Finally, Article 39 states the rules for conducting trials before courts-martial and the requirements for the evidence that is presented. In California, all military personnel must adhere to the laws and regulations of the Uniform Code of Military Justice (UCMJ) as outlined in Article 39. Violations of the laws of the UCMJ can result in a court-martial. A court-martial is a trial that is conducted in the same manner as a state or federal trial and is conducted in a military setting. The accused has the right to legal representation, the right to a speedy trial, and the right to have their case heard by a jury. The penalties for violating the UCMJ range from minor punishments such as a reprimand, to a dishonorable discharge, to confinement or even the death penalty.
