What is the Military Rules of Evidence (MRE)?
The Military Rules of Evidence (MRE) are a set of rules that govern the collection, use, and presentation of evidence in the courtrooms of the United States military in Washington State. The MRE is different from the Federal Rules of Evidence (FRE) used by civilian courts, as the military has unique needs when it comes to courts-martial proceedings. The MRE is a combination of the Federal Rules of Evidence and other regulations and guidance in interpreting the UCMJ and other military cases. The MRE consists of 14 different rules outlining different types of evidence that can be used in a military courtroom. These rules include rules regarding the admissibility of evidence, its weight, and its form. For example, the qualification of witnesses, the rules of witness credibility and impeachment, hearsay and its exceptions, authentication of documents, and the exclusion of certain evidence as inadmissible. The Military Rules of Evidence are essential to the outcome of military courts martial proceedings, as they dictate what evidence may be submitted and considered by a court, as well as its weight. They also ensure that all proceedings are fair and impartial, and that all parties are given the opportunity to present their cases. Without them, trials in the military justice system would be hindered and the outcomes would be uncertain.
