What is the Military Rules of Evidence (MRE)?

The Military Rules of Evidence (MRE) is a set of rules and regulations that apply to the courts-martial of military personnel in North Dakota, as well as the rest of the United States. This set of rules provides the framework for criminal proceedings and trials, and governs how evidence is gathered and presented in court. The MRE are divided into two main parts: the Rules of Procedure and the Rules of Evidence. The Rules of Procedure provide guidance on how a court-martial should be conducted. This includes how military personnel can be charged, who presides over proceedings, how witnesses are called, and more. It also sets out the process for appeals and changes of venue. Meanwhile, the Rules of Evidence outline the rules for gathering evidence and how it can be used in court. This includes the types of evidence that can be used, when and how witnesses are called, and the use of expert testimony. It also sets out the standards that must be met to allow evidence to be used at a court-martial. In North Dakota, the MRE are enforced by the United States Court of Military Appeals and any military personnel tried in a court-martial must follow the MRE. By following the rules and regulations of the MRE, military personnel can ensure that their rights are protected and that the proceedings are conducted fairly.
