What is NJP, or non-judicial punishment?

Non-judicial punishment (NJP), more commonly referred to as “Article 15”, is a form of military justice in New York. It is an administrative action used to enforce military laws and regulations that is imposed by a commander rather than a court-martial. NJP is typically used in situations involving minor disciplinary offenses. The purpose of NJP is not to punish a defendant, but rather to provide a means of corrective measures to the military personnel. This allows commanders to enforce standards of conduct without having to go through the lengthy process of a court-martial. In New York, NJP is imposed by the commander and is comprised of three elements. First, the commander will advise the offender of the charges and the maximum punishment. Then, the commander will give the offender a chance to explain what happened. Lastly, the commander will then decide if NJP is appropriate and, if so, administer the punishment. Possible punishments for NJP can include reduction in rank, forfeiture of pay, extra duties, restriction of privileges, or even a reprimand. NJP is an important discipline tool available to commanders in New York to maintain order and discipline within their units. If you are facing NJP, it is important to seek the assistance of an experienced military law attorney who will be able to advise you of your rights and help you defend yourself against the charges.
