What is the difference between a medical malpractice lawsuit and a class-action lawsuit?
A medical malpractice lawsuit and a class-action lawsuit are two very different legal proceedings. A medical malpractice lawsuit is a lawsuit brought against a medical professional or a medical facility for negligence, incorrect diagnosis, or wrongful treatment. The lawsuit is usually brought forward by the patient (or their legal representative) who experienced the issue and is seeking to receive compensation, typically in the form of a financial award. A class-action lawsuit, on the other hand, is a type of lawsuit in which a group of people with the same or similar interests join together and file a claim against an entity (typically a company or organization). This type of lawsuit is filed when the individuals feel that the entity has wronged them in some way, usually through discrimination or unfair practices. The group members share any such compensation they may receive from the lawsuit. In Iowa, medical malpractice lawsuits must be filed within two years of the date of the injury or death that results from the malpractice, while class-action lawsuits do not have a specific timeline. In addition, each medical malpractice case is unique and must be decided on its own merits, while a class-action lawsuit decision will affect all members of the class.
