What is the law of towage?

The law of towage is a part of Maritime Law that defines the rights of a towing vessel and the rights of the vessel being towed. In New York, the law of towage is based on the principle of “implied contract.” This means that when two ships enter into a towing agreement, an implied contract is created. The law of towage states that the towing vessel must exercise “reasonable skill and care” when towing another vessel. This includes making sure that the vessel is properly secured to the towline and that the towing vessel takes all safety precautions necessary. The vessel being towed also has certain rights; they must be given sufficient notice of the towing arrangement, as well as a reasonable time to prepare their ship for the voyage. They must also be given an opportunity to protest the tow if they believe it is unsafe or contrary to their interests. The vessel being towed is also entitled to safe and secure towing conditions. The law of towage establishes the duties and responsibilities of both the towing vessel and the vessel being towed in any towing agreement. It is important for both parties to be aware of the law of towage and its requirements in order to ensure a safe and secure towing situation.
