What is the law of salvage?

The law of salvage describes a situation where a person or company rescues another vessel or its cargo from losses at sea, and is entitled to compensation for his or her efforts. In Colorado, the law of salvage is governed by maritime law and includes numerous provisions to ensure that both parties are treated fairly. The law of salvage grants the salvager a certain percentage of the total value of the salvaged property as a reward for their services. The amount of compensation a salvager can receive is determined by the degree of difficulty or risk involved in the salvage operation. Generally speaking, more hazardous salvage operations are rewarded with higher rewards. To be entitled to receive compensation, the salvager must have acted without negligence or intention to cause the incident in the first place. Additionally, they must have provided services that is deemed beneficial, or at least not harmful, for the salvaged vessel. The salvager must also demonstrate that they acted in a timely manner and also considerate of the safety of the crew on the rescued vessel. To protect the interests of both parties involved, the law of salvage provides for an independent arbitration process that evaluates the various claims of each side and sets an appropriate amount of compensation. The determination of these claims is based on the reasoning of a panel of experienced legal professionals in maritime law.
