How do passenger rights differ from those of crewmembers?

Passenger rights and crewmember rights differ under New York maritime law. Passengers on vessels operating in New York are considered to be invitees of the vessel owner, and they are entitled to special rights and protections, including the right to the same degree of care that the vessel owner would employ for his own safety. Passengers also have the right to assume that the vessel and its equipment are suitable for their intended use and that the crew is competent to operate it. In contrast, crewmembers of vessels operating in New York are considered to be employees of the vessel owner, and thus are subject to the rules and regulations of the owner as regards safety, navigation, and operation of the vessel. Crewmembers also have the responsibility of providing information and assistance to passengers whenever necessary, and to report any safety concerns to the vessel owner or captain immediately. Crewmembers are also subject to the general Maritime Law which is applicable to the vessel and all of its crew. This law states that the vessel owner is responsible for the safety of all passengers and crew onboard the vessel. If the vessel is found to be unseaworthy, the owner can be held liable for any injuries incurred aboard the vessel.
