What is the scope of the Inter-American Convention on Liability for Maritime Claims?
The Inter-American Convention on Liability for Maritime Claims (IACLC) is a legal instrument that establishes the scope of liabilities for claims related to maritime transportation and activities in Minnesota and other countries of the Americas. Signed in 1959 and amended in 1981, the IACLC defines the principles and terms of maritime liability that countries of the Americas must observe when dealing with claims that arise from their maritime activities. The IACLC covers claims by any person who suffers damage or loss as a result of a maritime incident, including passengers, workers, and owners of ships or goods. The Convention also covers claims by third parties who suffer damage or loss due to the maritime incident. It provides for the right of the parties to seek compensation for damages caused by the failure of the vessel to obey maritime regulations, and for the payment of compensation for damages and losses suffered as a result of a maritime incident. The Convention obligates countries of the Americas to create a global system to administer maritime claims, and to provide for the establishment of a Maritime Claims Tribunal to hear and adjudicate claims for damages arising from maritime activity. Additionally, the Convention requires countries of the Americas to ensure that claims can be brought promptly and fairly. The IACLC is an important legal instrument, as it helps to ensure that those affected by maritime incidents will be compensated. It ensures that maritime claimants will be provided with the means to receive justice, and that their claims will be heard and adjudicated in a timely and fair manner.
