How can municipal laws be amended or repealed?
In Florida, municipal laws can be amended or repealed in several ways. Generally, the City Council has the authority to amend or repeal municipal laws. The amendment or repeal of a municipal law may be proposed by an individual council member, the mayor, or a citizen. If the amendment or repeal is proposed by a citizen, the City Council must decide whether to act on it. If the City Council decides to act on the proposed amendment or repeal, the City Council will hold a public hearing to allow the public to comment on the proposed measure. After the public hearing, the City Council will vote on whether to pass the amendment or repeal the ordinance. The City Council is also the governing body responsible for enacting municipal laws. As such, the City Council has the authority to repeal any municipal law that it has previously passed. Finally, if the City Council does not want to take action on the proposed amendment or repeal, the proposed measure will be put on the public ballot during an election. The citizens will then be allowed to vote on whether they want to amend or repeal the municipal law. In all cases, the amendment or repeal of a municipal law must be in accordance with the state constitution and laws of Florida. Therefore, even if the City Council decides to amend or repeal a municipal law, the municipal law must be legally enforceable.
