How is a municipal bankruptcy declared?

In West Virginia, a municipality declaring bankruptcy must comply with the federal Bankruptcy Code. This means that to declare a municipal bankruptcy, a municipality must file a petition for relief in a federal bankruptcy court. The municipality must include certain information in the petition, including its creditors and debts, assets and liabilities, and a statement of financial affairs. In the petition, the municipality must demonstrate that it is unable to pay its debts as they become due and that it is insolvent (no longer able to pay its creditors in full). The municipality must also demonstrate that it has considered all alternatives to filing for bankruptcy such as refinancing or restructuring its debt. If a municipal bankruptcy filing is accepted, the bankruptcy court will appoint a trustee to oversee the bankruptcy process in order to ensure that the municipality complies with all relevant laws. This trustee may negotiate with creditors on behalf of the municipality and may discharge or reorganize some of the municipality’s debts. In West Virginia, a municipal bankruptcy is a difficult and expensive process. It can cause disruption to the municipality’s operations and can significantly damage its credit record. As such, municipal bankruptcy should only be considered as an absolute last resort.
