What is the extent of the municipality's authority over local businesses?
In Florida, municipal governments have the authority to regulate local businesses within their jurisdiction. This includes the ability to impose zoning restrictions, pass regulations for the health and safety of citizens, and collect taxes from businesses in the form of business licenses and fees. The extent of the municipality’s authority over the local businesses’ operations is limited. As an example, the municipality cannot impose regulations on the price or quality of a business’s goods or services. They also may not intervene if a business has a dispute with their customers, unless it involves a violation of a local ordinance. Additionally, municipalities cannot require businesses to employ certain people or require that they change their hours of operation or job duties. Although municipalities may put restrictions on such things as noise levels and the types of businesses that can be operated, these restrictions cannot be applied to existing businesses without due process. In addition, municipalities have the authority to impose environmental regulations to ensure compliance with state and federal laws. For example, they can enforce regulations regarding hazardous materials and air and water quality as specified by the state. The extent of the municipality’s authority over local businesses is limited, but when businesses are in compliance with applicable local and state laws, the municipality’s control over them is still significant.
