What is the legal status of a municipality in relation to state and federal laws?

A municipality is a political subdivision of a state that has legal status and certain rights and responsibilities. In West Virginia, municipal law outlines the legal status of these municipalities in relation to state and federal laws. At the most basic level, the state government will create municipalities, setting out the boundaries, powers, and duties that define each municipality. Once created, a municipality is considered a municipal corporation and has the right to act like a natural person, meaning it can create laws, sue and be sued, and purchase and own property. This legal status also gives municipalities the ability to levy taxes and issue bonds without the consent of the state. In addition to state laws, municipalities must comply with federal laws with regards to civil rights, minimum wage, the environment, and other regulations. This means local governments must make sure they are abiding by laws like the Clean Air Act, the Fair Labor Standards Act, and the Americans with Disabilities Act, just to name a few. Overall, municipalities have a unique legal relationship with state and federal government. They are independent entities and subject to state and federal laws, while being able to exercise their own legal authority. Despite this balance of power, municipalities can still have significant decision-making power through their own laws, regulations, and taxes.
