What are the procedures for establishing a municipal fiscal year?
In Texas, the procedures for establishing a municipal fiscal year are outlined in the Texas Local Government Code. According to this code, the mayor, or presiding officer, of a municipality must call a meeting of the governing body of the municipality. At this meeting, the governing body must establish a fiscal year for the municipality that will begin on September 1 and end on August 31 of the following year. The governing body must also publish a notice of the meeting in a newspaper of general circulation in the municipality at least 20 days before the meeting. The notice should include the date, time, and place of the meeting, as well as the purpose of the meeting. Moreover, the governing body of a municipality may also amend the fiscal year by making a resolution that would amend the fiscal year for the current year. In addition to those responsible for establishing the municipal fiscal year, there are other individuals that must be informed of the change in the municipal fiscal year. For instance, the Comptroller of Public Accounts, county auditors, and the Department of Public Safety must all receive the notice of the change in the fiscal year. Lastly, after the governing body has established a municipal fiscal year, the municipality must publish a notice of the action in a newspaper of general circulation in the municipality within 30 days after the meeting. This notice should include the beginning and end dates of the fiscal year.
