What is the Native American Graves Protection and Repatriation Act?

The Native American Graves Protection and Repatriation Act (NAGPRA) is a federal law that was passed in 1990 to protect Native American cultural heritage. This Act applies to Native American graves, cultural items that are owned by the federal government, and items that have been taken from Native American burial sites. The NAGPRA requires museums, universities, and other federal agencies to inventory and identify Native American human remains and any related grave goods, such as funerary objects. It also requires that these institutions consult with and obtain consent from the appropriate Native American tribe before taking any action relating to the remains or grave goods. In Vermont, the NAGPRA applies to all Native American cultural resources that have been located or taken from Federal or Tribal lands. It also applies to collections that are held by any Federal or Tribal agency or museum. Any NAGPRA-related activities that are conducted in the state must be coordinated with the appropriate Tribal Historic Preservation Officer(THPO) in order to ensure that all federal laws and regulations are followed. Additionally, all Native American burials must be recorded and appropriately marked so that they can be protected in the future. The NAGPRA is an important piece of legislation that helps to protect Native American cultural heritage and ensure that all Native American graves are treated with respect. It is an important part of Vermont’s history and its culture, as it allows for the preservation and repatriation of Native American artifacts and remains.
