What is the Indian Gaming Regulatory Act?
The Indian Gaming Regulatory Act (IGRA) is a federal law enacted in 1988 that regulates gaming activities conducted on Indian lands in the United States. This law is designed to provide a framework that allows Indian tribes to conduct gaming activities on their land while still meeting the goals of protecting tribal sovereignty and ensuring that gaming activities are fair and properly regulated. The IGRA established three different classes of gaming activities: Class I, which includes traditional tribal games such as stick games; Class II, which includes gaming activities such as bingo, lotto, and pull-tabs; and Class III, which includes casino-style gaming activities such as slot machines and table games. The IGRA also established the National Indian Gaming Commission (NIGC), which is responsible for overseeing gaming activities and regulating the conduct of any Indian Gaming Facility. In Florida, the state recognizes the right of Indian tribes to engage in gaming activities, and the State of Florida has entered into several gaming compacts with Indian tribes in order to regulate this activity. These compacts provide rules and regulations for the conduct of Class II and Class III gaming activities, and they also provide for the payment of taxes and fees by the operators of Indian gaming facilities. The IGRA is an important piece of legislation for Indian tribes throughout the United States, and its importance is heightened in Florida, where the state has entered into several compacts in order to regulate gaming activities on Indian land. The IGRA provides a framework for Indian tribes to engage in gaming activities while still upholding the goals of protecting tribal sovereignty and ensuring the proper regulation and fairness of gaming activities.
