What is the Indian Gaming Regulatory Act?
The Indian Gaming Regulatory Act (IGRA) is a federal law created in 1988 that regulates all Native American gaming activities within the United States. It created the National Indian Gaming Commission to oversee the licensing and regulation of gaming activities on tribal lands, and to ensure that all gaming activities are conducted in accordance with the federal law. The IGRA divides gaming into three classes: Class I, Class II, and Class III. Class I gaming includes social games for minimal stakes, traditional ceremonial or religious activities, and other activities of a similar nature. Class II gaming covers bingo, pull-tabs, lotto, punch boards, and other nonbanking card games. Class III gaming includes all other forms of gaming, such as casino-style gaming, slots, and blackjack. In South Carolina, tribal gaming is governed by the South Carolina Indian Gaming Regulatory Act and the Tribal Gaming Compact, which was established and negotiated in 2011 between the state and the Cherokee Nation. The IGRA applies to all tribal gaming conducted in the state, and requires that all gaming activities comply with the federal law and the terms of the Tribal Gaming Compact. The IGRA was created to protect tribal gaming activities from abuse and exploitation, and to ensure that tribal gaming activities are conducted in a fair and lawful manner. It sets the rules and regulations for the regulation of gaming activities in Indian Country. The act also provides the necessary protocols for the negotiation and formation of Tribal-State gaming compacts, which are essential in enabling the lawful conduct of gaming activities.
