What is the Indian Self-Determination and Education Assistance Act?
The Indian Self-Determination and Education Assistance Act (ISDEAA) was enacted in 1975 and is a federal legislation that establishes the policy of self-determination for all Native American tribes in the United States. The Act allows tribes to assume responsibility for administering programs that are normally administered by the federal government. The funding for these programs is provided by the United States government and administered directly to tribal governments. In Utah, the ISDEAA serves as the main legal framework for tribal governments to manage their own affairs. It allows tribes to take control of their most important decision-making, such as health care, education, economic development, land management, natural resources, and other matters related to tribal self-governance. The ISDEAA does not only guarantee tribes the right to self-governance, but also the right to receive the financial resources to carry out these decisions. The ISDEAA has been credited for empowering Native American tribes in Utah, as it has allowed them to take ownership of their lands and resources. Additionally, it has allowed them to create new forms of tribal government, including Tribal Health Organizations and educational programs designed to serve Native American children. The ISDEAA has enabled Native Americans in Utah to achieve self-determination and create the kind of tribal government that reflects their values and culture.
