What is the Indian Education Act?

The Indian Education Act is a South Carolina law that aims to provide equal educational opportunities for Native American students. The law was enacted in 1987 and is grounded in the commitment of the state to honor the distinct culture of its Native American population and to ensure that all students receive an equitable education. The Indian Education Act defines the specific responsibilities of public school districts as they relate to Native American students. These include providing instruction on Native American history, culture, and language; conducting activities that celebrate the culture of Native American students; and providing access to programs that support Native American students’ academic and social development. Moreover, the law requires school districts to form a Native American Advisory Group which would give Native American families and their community a voice in the policymaking process. This group informs school district officials about local Native American issues and has the authority to advise the school board regarding changes to the curriculum to benefit Native American students. In addition, the Indian Education Act outlines procedures for the recruitment and hiring of Native American educators for instructional and administrative roles in South Carolina public schools. It also requires that Native American students receive instruction on certain ethnic and cultural topics, such as Native American history, customs, beliefs, and languages. Finally, the Act requires school districts to provide Native American students with access to extracurricular activities that promote an understanding of their culture and heritage. These activities include field trips, cultural celebrations, and other activities that help Native American students gain an appreciation for their rich culture.
