What is the role of an expert witness in a negligent security case?
An expert witness plays an important role in a negligent security case in California. In some cases, the expert witness can provide valuable evidence which helps the plaintiff prove their case. For example, an expert witness may be asked to provide opinions on the standard of care which is prevalent in the area and industry in which the defendant is operating. By doing so, the expert witness shows how the defendant’s actions (or inactions) fell short of that standard of care. Expert witnesses may also be asked to provide opinions about the facts of the case. This could include opinions about whether or not the defendant’s conduct was reasonable given the particular circumstances which were in place at the time. In short, an expert witness helps the court understand the details of the case and the applicable standard of care.
