Do nonprofits have to pay minimum wage?
In New York, nonprofits must adhere to the same minimum wage laws as for-profit businesses. This means that nonprofit organizations must pay their employees at least the state minimum wage, which is currently $11.80 per hour in New York. Additionally, nonprofits must comply with other state laws that govern wages and working conditions. This includes the requirement to pay overtime if the employee works more than 40 hours per week and the obligation to issue pay stubs that accurately and completely detail the employee’s wages and deductions. Nonprofits may also be subject to additional wage and hour regulations, depending on the type of organization and the nature of the work performed. For example, employees of nonprofits that receive certain types of federal funding may be entitled to earning higher wages than the state minimum wage. Although nonprofit organizations are exempt from paying certain taxes, they are still responsible for adhering to minimum wage and other labor laws when employing staff. Therefore, nonprofits must ensure that their employees are paid at least the New York state minimum wage and are provided with other essential benefits and protections under the law.
