What is the difference between abuse and neglect in nursing homes?

In California, the difference between nursing home abuse and neglect lies in the intent of the perpetrator. Abuse is intentional, whereas neglect is a result of careless or reckless behavior. Nursing home abuse is defined by California law as the willful infliction of physical pain or injury, mental suffering, or emotional distress. It also includes sexual abuse, intimidation, exploitation, or deprivation of rights or services. An example of nursing home abuse would be hitting a resident, or taking their possessions without their consent. On the other hand, nursing home neglect is a form of negligence and describes the failure of the staff to provide a resident with the minimal level of care that is necessary to maintain the resident’s physical and mental well-being. An example of neglect would be if the staff did not regularly check on the resident, provide nutritious meals, or if staff members failed to provide enough assistance for the resident to perform daily activities like dressing and bathing. Together, nursing home abuse and neglect are considered forms of elder abuse and both are serious crimes in California. Anyone who suspects nursing home abuse or neglect should contact the proper authorities immediately.
