What legal recourse do I have if a nursing home fails to provide adequate care?
If you believe that a nursing home has failed to provide adequate care for your loved one, you have legal recourse under Colorado law. The state requires nursing homes to provide residents with a safe, comfortable, and dignified environment, as well as a level of care that meets or exceeds their individual needs. In Colorado, victims of nursing home abuse or neglect have the right to file a civil lawsuit against the facility. The lawsuit will seek to hold the facility liable for any harm or losses suffered by the victim, including medical expenses, pain and suffering, and emotional distress. In addition to a civil lawsuit, victims can also file a complaint with the Colorado Department of Public Health and Environment. This complaint will be investigated and if the department finds that the facility is not providing adequate care, they can take administrative or disciplinary action. This could include imposing fines or revoking the facility’s license, depending on the severity of the case. Victims of nursing home abuse or neglect are also entitled to file a criminal complaint with the police. This complaint must be filed within two years of the alleged incident. Depending on the circumstances, criminal charges may be filed against the facility, its staff, or other responsible parties. Finally, victims have the right to seek compensation through the Colorado Nursing Home Abuse Victim Fund. This fund is designed to provide financial assistance to victims of nursing home abuse and neglect.
