What are the consequences for nursing homes that do not meet standards of care?

In Texas, nursing homes that fail to meet the standards of care set by the state face a variety of consequences. These consequences range from fines to revocation of a nursing home’s license. When a nursing home fails to meet standards of care set by the state, they can be fined or have their license revoked. Depending on the severity of the violations, the fines can be up to $10,000 and include additional fees for each day the violation is not corrected. Additionally, the state can require nursing homes to pay for additional staff or equipment. In cases of abuse or negligence that results in injury or death, a nursing home can also face criminal charges. Under Texas law, nursing home staff can be charged with assault, battery or homicide if the abuse or negligence results in serious harm or death. The penalties for these crimes can range from probation to prison time. In addition to fines and criminal charges, nursing homes that fail to meet standards of care may be subject to investigations by the state. The results of these investigations can lead to more fines and/or license revocation. A nursing home that has its license revoked will be unable to operate, and its patients will have to be transferred to other facilities. It is important for nursing homes to abide by the standards of care set by the state in order to avoid these consequences.
