What is the difference between nursing home abuse and elder abuse?
Nursing home abuse and elder abuse are two distinct forms of mistreatment and exploitations of the elderly. Both types of abuse can have devastating impacts on elderly people, but they have different definitions and are governed by different sets of laws in South Carolina. Nursing home abuse is an intentional act carried out by an individual in a nursing home facility. It can take many forms, such as physical, emotional, psychological, and sexual abuse. It also includes neglect and even financial exploitation. Nursing home abuse is covered under Article 5, Chapter 1 of the South Carolina Code of Laws. Elder abuse, on the other hand, refers to mistreatment of a senior that can be committed by a family member, friend, or caregiver. It can also involve neglect, financial exploitation, and physical, emotional, or sexual abuse. Unlike nursing home abuse, elder abuse is not limited to a long-term care facility. Elder abuse is governed by the South Carolina Vulnerable Adult Protective Services Act, which was signed into law in 2004. In short, nursing home abuse is an intentional act committed in a nursing home, while elder abuse is any mistreatment of a senior, committed by anyone, in any setting. Both forms of abuse are illegal in South Carolina and are covered under different sets of laws.
