Are there any legal protections against financial exploitation of nursing home residents?
Yes, there are legal protections against financial exploitation of nursing home residents in New Jersey. The New Jersey Adult Protective Services Act (APS) provides protection for nursing home residents from financial exploitation by third parties. The APS allows nursing home staff to monitor financial transactions and report any suspicious activity to local law enforcement. In addition to the APS, the New Jersey Department of Human Services (DHS) provides a Nursing Home Resident Bill of Rights which protects the financial assets of nursing home residents. The bill provides that nursing home residents have the right to manage and control their financial accounts and access their bank accounts. Nursing home staff are also required to respect the financial choices of the resident. Under New Jersey law, it is also a crime for third parties to exploit nursing home residents and failing to report suspected financial exploitation can result in criminal sanctions. In addition, any nursing home staff who are found to have taken money or property from a resident can face civil and criminal charges. To help protect nursing home residents from financial exploitation, the state of New Jersey also has a Financial Exploitation Reporting System (FERS) which allows individuals to report suspected exploitation and request assistance from the state. The FERS also provides information on resources available to help nursing home residents and their families protect themselves from exploitation.
