What are the penalties for nursing home owners and staff found guilty of abuse?

In Minnesota, there are several penalties that nursing home owners and staff found guilty of abuse may face. Depending on the severity of the abuse, the penalties can range from a civil penalty, to criminal charges. If the abuse is found to be of a lesser degree, the penalty is most often a civil penalty. The Minnesota Department of Health is responsible for monitoring nursing homes and conducting investigations of abuse claims. If abuse is found, an administrative penalty can be imposed. This may include fines, suspension of the facility’s license, or revoking the license entirely. On the other hand, if the abuse is found to be of a more serious nature, criminal charges may be brought against the abuser. If convicted of criminal abuse, the owner or staff member may face jail time, probation, and/or fines. Minnesota law also allows for those found guilty of abuse to be held liable for the costs of medical care related to the abuse. This can include reimbursement of medical bills, compensation for pain and suffering, and other related costs. It is important to note that nursing home abuse is a serious crime. Victims and their families should not hesitate to report any incidents of abuse and seek legal counsel.
