In South Dakota, nursing home owners and staff found guilty of abuse are subject to strict penalties. These penalties are based on the severity of the abuse and can range from a simple fine to a long-term prison sentence. A first offense is generally considered to be a misdemeanor and may be punishable by a fine of up to $500 and/or prison time of up to 30 days. If the abuse results in serious bodily injury, then it is considered a felony and the offender may face a fine of up to $5,000 and/or a prison sentence of up to five years.
