What rights do I have to use oil and gas produced from my land?
In California, if you own land, you generally have the right to use the oil and gas resources found on that land. This right, known as the right of "ownership and control," allows the landowner to use the oil and gas resources on their land as they deem fit, subject to any applicable laws. Owners of land in California also have the right to enter into agreements with oil and gas companies to drill and produce the oil and gas resources found on their land. This right is known as the right of "surface use," and generally grants owners the right to negotiate with oil and gas companies to allow them access to the resources on their land. Generally, this comes in the form of a lease or contract between the landowner and the oil and gas company. In return for allowing the oil and gas company to access the resources on their land, the landowner is usually entitled to a portion of the profits from the sale of the resources, as well as any other compensation that might be required for the use of the land. Finally, landowners also have the right to challenge or appeal certain actions or decisions that have been taken by the oil and gas company with respect to the production of oil and gas on their land, such as the terms of the lease or contract, the amount of royalties paid, or any other related matters. Such disputes are typically addressed through the California legal system.
