What is the legal definition of an abandonment of an oil and gas well?

An abandonment of an oil and gas well is when the owner of a well (or the holder of a lease on a well) abandons their right to extract any oil or gas from the well, and removes their equipment and infrastructure from the well. In Washington, abandonment is defined in various regulations, including Title 344 of the Washington Administrative Code. The abandonment process must begin with a notice of abandonment and must detail all of the activities that are needed to be done to ensure that the well is properly abandoned. This includes removing all equipment, pipes, and other items; abandoning any storage tanks, holding tanks, or other storage structures; and plugging the wellbore with thick concrete, bentonite clay, or other acceptable sealing materials. The state of Washington requires that these steps and any other activities necessary for proper abandonment be completed for wells that are no longer producing, or that have been idle for more than five years. Once the abandonment process is complete, the state will issue an abandonment certificate, which officially certifies that the abandonment has been completed and that the well has been permanently plugged and abandoned.
