What are the requirements for parole or probation?

In Kansas, parole and probation are both options for relief from a sentence handed down from a court. Parole is a process where the inmate is released from prison, after serving at least part of the imposed sentence in prison, but with additional restrictions and requirements. Probation is a sentence that allows an offender to remain in the community, subject to certain conditions and requirements, in lieu of a more severe sentence. To be eligible for parole or probation, an offender must meet several requirements. Generally, the offender must agree to abide to the conditions of parole or probation, and must have a residence where they will live. The offender may need to demonstrate that they are able to make positive changes in their life. Parole conditions generally include an agreement from the parolee to obey all laws and refrain from any criminal activity, participate in any court-ordered treatment or treatment program, and complete and report any required community service. Other conditions may include periodic reporting to a parole officer, who will provide oversight and guidance to the offender. Probation requirements may be more specific than those for parole. Generally, probation includes restrictions to prohibit drug or alcohol use, comply with a curfew, not associate with certain people or locations, and submit to random drug or alcohol testing. The offender may be required to report to a probation officer monthly, in addition to completing any court-ordered programs or treatment. In both cases, if the offender fails to comply with any conditions of parole or probation, their parole or probation may be revoked and they may be sentenced to serve out the remaining portion of their sentence in prison.
