How do I challenge a violation of parole or probation?
In California, challenging a violation of parole or probation can be done through the court system. The process begins when the parole or probation officer files a “petition for violation” with the court. This petition outlines any alleged violations of the terms of probation or parole. Once the petition is filed, a hearing will be scheduled. The probationer or parolee will be served with a notice of the hearing and will have an opportunity to challenge the alleged violation. The parolee or probationer can dispute the facts in the petition or argue that the violated terms of parole or probation were not clear or unambiguous. At the hearing, the parolee or probationer can present evidence or argue why the court should not consider the alleged violation as serious. The court can then decide whether to revoke or modify the terms of parole or probation or dismiss the violation if they feel the parolee or probationer has presented evidence that the violation was insufficient to warrant revocation or modification. If the court finds that the violation is valid, the parolee or probationer will have the opportunity to appeal the decision to a higher court. If, however, the court agrees that the violation was insufficient for revocation or modification, the terms of parole or probation will remain unchanged.
