What is considered a breach of parole or probation?

A breach of parole or probation is an act that violates the terms of a person’s parole or probation order. In the state of Florida, serious violations of parole or probation can result in a person being arrested and re-incarcerated. A few examples of violations that may be considered a breach of parole or probation include failure to report to a probation or parole officer, possession of a firearm, engaging in criminal activity, or being arrested for a new offence. If a person on parole or probation is accused of violating the terms of their order, they will be required to appear before a judge. The judge will review the details of the incident and determine if a person did indeed violate the terms of their parole or probation. If the judge determines that the person did commit a breach of parole or probation, they could be re-incarcerated or have their parole or probation revoked. Additionally, a person may be issued additional restrictions or ordered to complete other conditions as a part of their release. In some cases, probation officers are responsible for monitoring an offender’s activities to help ensure that they remain in compliance with their parole or probation order. These officers can provide guidance and assistance to help ensure that a person on parole or probation is able to remain in compliance. Probation officers may also take action on behalf of the court if they believe a person is in violation of their order.
