How can I appeal a parole or probation revocation decision?
If you disagree with the decision of a parole or probation revocation in Nevada, you may be able to appeal the decision. First, you must file a written request for an appeal within 14 days of the decision. This should be sent to the Nevada Board of Parole Commissioners. In your request, you must explain why you are appealing. Once your appeal request is received, the board will review your claim. If they decide to hear your claim, they will schedule a hearing. At the hearing, you may have representation from an attorney and have witnesses testify on your behalf. At the end of the hearing, the board members will decide whether your parole or probation can be reinstated. If they decide that you can remain on parole or probation, all conditions of your parole or probation set by the court will be reinstated. If your claim is not upheld, you may have the right to appeal to the Nevada Supreme Court. A lawyer may be able to help you file this appeal and can guide you through the process. If your appeal is unsuccessful, the board’s decision will be final and your parole or probation revoked. However, in certain cases, you may be able to apply for an early release from prison if you have served half of your prison sentence. You should speak to a lawyer if you are considering this option.
