What happens if a man denies paternity after signing an acknowledgment?
If a man signs an acknowledgment of paternity in South Dakota, he is legally considered the father of the child and is therefore responsible for financial and emotional support. However, if a man later denies paternity after signing the acknowledgment, he may be able to legally challenge the acknowledgment and prove that he is not the father of the child. In order to challenge the acknowledgment, the man must go to court and prove that he is not the father of the child. He can do this by supplying evidence that suggests he is not the father, such as the results of a DNA test. Once the test results are determined, the court will make a final decision and determine whether the man is the biological father or not. It is important to note that while a man can legally challenge paternity after signing an acknowledgment, it is not a guarantee that the challenge will be successful. If the challenge is unsuccessful, the man will still be considered the father of the child and will be responsible for any financial and emotional support the child needs. It is also important to realize that challenging paternity after signing an acknowledgment is a difficult process and can take a long time before a definitive answer is reached.
