What types of losses can I claim in a pedestrian accident?

In New Mexico, pedestrians who are injured in an accident caused by someone else’s negligence are entitled to damages for their losses. Types of losses that can be claimed in a pedestrian accident include economic damages, such as medical bills, lost wages, and property damage, as well as non-economic damages, such as pain and suffering, emotional distress, inconvenience, and loss of enjoyment of life. Economic damages, or compensatory damages, are designed to compensate a person for the actual financial losses they incurred directly related to the accident. These damages include medical bills, lost wages, and damage to a victim’s vehicle or other property. If a pedestrian needed to be taken to the hospital by ambulance, for instance, they would be entitled to seek compensation for the cost of the ambulance ride. Non-economic damages are designed to compensate a person for losses that cannot be quantified in terms of economic value, such as pain and suffering, inconvenience, emotional distress, and loss of enjoyment of life. These damages are calculated based on the degree and extent to which the accident damaged the pedestrian’s life. In New Mexico, pedestrians have a right to sue for both economic and non-economic damages in the event of an accident caused by someone else’s negligence. A pedestrian can seek compensation for any and all of the losses they suffer as a result of an accident.
